1. Consultancy assignment background

The Norwegian Refugee Council is an international, independent, humanitarian, non- governmental organization that provides assistance to refugees’ and internally displaced people in many countries worldwide including Libya. As a part of its assistance, NRC provides information, counselling and legal assistance (ICLA) services to empower beneficiaries and support them to claim and exercise their rights. NRC beneficiaries include: Refugees, internally displaced people, and members of host community.

In order to achieve these aims, NRC’s ICLA programme is seeking a consultant to provide legal services to beneficiaries, and provide specialised legal advice to the ICLA team on legal issues relevant to refugees and internally displaced people.

independent, humanitarian, non-profit, non- governmental organization, which provides assistance, protection and durable solutions to refugees and internally displaced persons worldwide. NRC has been working in Libya providing protection and assistance to internally displaced people and host communities through implementation of activities in Shelter, Education, Cash Assistance and Information

Counselling and Legal Assistance.

The consultant will be providing Legal

assistance, specialised legal advice/services relevant to refugees, and internally displaced people inside Libya.

2. Objectives and scope of work

Objectives

The Consultant will be responsible for providing

legal advice and representing refugee and asylum seeker beneficiaries, on behalf of NRC, in the execution of a project entitled ‘Legal aid services    for    internal    displaced    persons,refugees and asylum seekers. The thematic area of the legal advice and assistance will relate to residency, tenancy rights, work rights and civil documentation, in line with ICLA’s global thematic focus.

Scope of work

The consultant will conduct this field-based

consultancy in Tripoli, working 3 days a week, or as many hours required for the completion of the tasks set by the ICLA Manager. The Consultant will be responsible for providing legal advice and representing refugee and asylum seeker beneficiaries, on behalf of NRC, in the execution of a project entitled ‘Legal aid services for refugees and asylum seekers’. The thematic area of the legal advice and assistance will relate to residency, tenancy rights, work rights and civil documentation, in line with ICLA’s global thematic focus.

• The consultancy will be carried out the work

during field activities and remotely through mobile approach where applicable

Providing legal advice to Internal displaced

persons and returnee from displaced in addition to the Refugee in Tripoli.

• Language requirements; Verbal and written

fluency in Arabic. English highly desirable

Major tasks and responsibilities

Set out below is a non-exhaustive list of the

legal work anticipated as part of the consultancy:

–           Conduct group legal information sessions with clients on relevant topics;

–           Consult with individual clients on their legal issues;

–           Provide clients with legal advice and representation in both formal and informal dispute resolution such as negotiation with third parties on behalf of beneficiaries, and representation before courts and government bodies;

–           Provide the ICLA team with technical advice, research and analysis of case law and legislation relevant to internally displaced people, refugees and other vulnerable people;

–           Prepare factsheets, brochures and other information material on legal rights

–           Work with other lawyers, and relevant actors, to advocate on key legal issues

and construct solid legal arguments

and strategies for cases, using applicable domestic and international law as necessary;

–           Identify potential legal cases;

–           Attend workshops, seminars and training sessions conducted by NRC

–           Provide the ICLA team with legal information and updates on relevant issues;

–           Maintain all relevant paperwork and update databases as needed;

–           Work on other tasks as needed.

3. Institutional     and      organisational

arrangements

The work plan of the Consultant will be set by

the ICLA Manager, in consultation with the ICLA PDM. The Consultant will work in close collaboration with the ICLA team in Tripoli, and provide technical support for activities conducted by the team on legal areas. The Consultant will also be responsible for providing legal assistance directly to NRC beneficiaries.

Include the following text, as appropriate:

NRC will own the intellectual property rights to

all materials submitted by the consultants under the contract. The consultants must therefore ensure that they have possession of any materials provided to NRC as a part of the deliverable. The rights to reproduce the reports will fall to NRC and its contracted agents. NRC will be free to reproduce the materials at will and to grant reproduction rights.

Duties of the consultant

The Consultant will conduct all activities under

this contract in line with NRC’s code of conduct and reflecting the behaviour expected of an NRC field activity. The Consultant is required to use their own computer and other resources to fulfil the requirements of the consultancy,

including transportation.

Reports should be submitted in Microsoft Word format, in UK English or Arabic. All text should be unformatted. Graphs or other graphical devices should be editable (i.e. not pictures). All references must be cited according to convention, and detailed in a bibliography, using the Harvard system as set out in the UNESCO Style Manual. All verbatim quotations must appear in quotation marks, and must not be of excessive length. All data collected under the consultancy must be submitted with the deliverables, in a widely recognized format such as Microsoft Excel.

Everything submitted to NRC must be the

original work of the consultants. Any plagiarism in any form, or any other breach of intellectual property rights, will automatically disqualify the consultant from receiving any further payments under the contract by NRC, and NRC will seek to recover any payments already made.

The consultant will follow Ethical Research

Involving Children guidance on the ethical participation of children. In addition, all participants in any study or other interaction will be fully informed about the nature and purpose of the interaction and their requested involvement. Informed consent must be obtained for any photographs, audio or video recordings, etc., in accordance with NRC’s policy on consent.

Duties of NRC

NRC will make a space available for the

Consultant to perform activities reaching beneficiaries, including when conducting information sessions, providing legal assistance and counselling sessions. All other times, a work space may be available for use at the NRC Tripoli office, for the Consultant to use, however this will depend on the occupancy levels of the office by NRC staff at the time who get priority.

4. Implementation schedule and estimated inputs From the start date, the activities of the Consultant will start and continue on a weekly basis until the conclusion of the contract date.
5. Qualifications of the consulting Experience and qualifications

The consultant has satisfied the requirements of the consultancy being A university degree in law An active license from the Libyan Bar

Association to practice law in Libya and proceed with the legal procedures before the courts.

Verbal and written fluency in Arabic with English familiarity

Proven experience and speciality in one of the Housing, land and following areas of law property

Legal residency and work rights for non-Libyans Personal status laws

Committed to working with internally displaced people, refugees and other vulnerable people; and supporting them to exercise their legal rights.
