Purpose of Activity/Assignment:

Under the overall supervision Child Protection Head, the consultant will provide support to the Justice for Children’s project. The consultant will be responsible for 1. ensuring the promotion of alternative to detention policies for migrant and refugee children in Libya; including through the development of referral pathways, 2. facilitate UNICEF’s support to Legal Aid Programs in Libya; 3. communication with relevant international stakeholders and government stakeholders. The work will be performed in close coordination with other sections, such as education and WASH.

Scope of Work:

1: Support/Technical Assistance: To ensure the promotion of alternative to detention policies for migrant and refugee children in Libya; including through the development of referral pathways; Specific Tasks Include:

1. In cooperation with the national consultant, review existing laws and policies around immigration detention and draft recommendations and potential entry points for UNICEF on legal drafting, gaps in the legislative system and potential way forward in Libya;

2. In cooperation with the national consultant, review existing laws/policies around alternatives to detention for Libyan and non-Libyan children and provide reports/recommendations on potential options for UNICEF

3. In cooperation with the national consultant, support the drafting and development of recommendations to the MOI and MOJ on child specific referral pathways as opposed to child immigration detention, promoting the release of children in detention and prevent the administrative detention of children;

4. To support the development of any other policies and standards for the promotion of alternative to detention of children including a) age assessment tools; b) alternative care standards;

5. To organize roundtables with the government and its key stakeholders, including the MOJ, preparing agendas, meetings’ meeting, drafting letters for the governments

6. Support the office with reporting on migration, justice for children

 

2: Support/Technical Assistance: To facilitate UNICEF’s support to Legal Aid Programmes in Libya; Specific Tasks include:

1. Provide advice and technical assistance on the feasibility of Legal Aid Assistance in Libya and if required, arrange meetings with legal aid actors.

2. Provide technical support for the finalization of partnerships with potential legal aid coalition and/or CSOs

3. Monitor and follow up on CSOs or Legal Aid Coalitions. 1. Maintain weekly contact with the international consultants with updates on progress and challenges and solutions.

 

3: Communication with relevant international stakeholders and government stakeholders (throughout the phases). Specific Tasks Include:

7. Maintain regular contact with CORAM and UNICEF with updates on project progress, challenges and solutions to organize roundtables with the government and its key stakeholders, including the MOJ, preparing agendas, meetings’ meeting, drafting letters for the governments.

To qualify as an advocate for every child you will have…

  • A Master’s Degree in law
  • 5 years of professional work experience in drafting analytical legal documents on Child Protection
  • Skills in quantitative and qualitative research analysis in child protection
  • Essential written and spoken English

Individuals engaged under a consultancy or individual contract will not be considered “staff members” under the Staff Regulations and Rules of the United Nations and UNICEF’s policies and procedures and will not be entitled to benefits provided therein (such as leave entitlements and medical insurance coverage). Their conditions of service will be governed by their contract and the General Conditions of Contracts for the Services of Consultants and Individual Contractors. Consultants and individual contractors are responsible for determining their tax liabilities and for the payment of any taxes and/or duties, in accordance with local or other applicable laws.

The selected candidate is solely responsible to ensure that the visa (applicable) and health insurance required to perform the duties of the contract are valid for the entire period of the contract. Selected candidates are subject to confirmation of fully-vaccinated status against SARS-CoV-2 (Covid-19) with a World Health Organization (WHO)-endorsed vaccine, which must be met prior to taking up the assignment. It does not apply to consultants who will work remotely and are not expected to work on or visit UNICEF premises, programme delivery locations or directly interact with communities UNICEF works with, nor to travel to perform functions for UNICEF for the duration of their consultancy contracts.
